The email arrived on a Friday afternoon. Subject line: "Follow-up to Vendor Questionnaire — AI Performance Management System." The questions are precise. The procurement team has done their homework.
This is the conversation that CTOs of HR tech companies are walking into in 2026. The EU AI Act classifies AI systems used to evaluate employees' performance as high-risk under Annex III (category 4: employment, workers management, and access to self-employment). That classification triggers a full documentation requirement before you can sell into EU enterprise accounts.
Here is how to answer the two most common sections.
Article 13 — Transparency and Interpretability
Article 13 requires that high-risk AI systems be transparent enough that deployers — in this case, your customer's HR team — can interpret outputs and use them appropriately.
The question usually arrives as: "How does your system generate performance ratings? Can our HR managers understand why an employee received a specific score?"
How to answer:
Start by distinguishing between the system's output and the underlying model. Your enterprise customer does not need to understand your neural network. They need to understand what the output means, what data drove it, and what weight each factor carries.
A strong answer lists the input signals (for example: goal completion rate, 360 feedback scores, time-to-resolution on open items), describes how those signals combine into a rating, and explains what HR managers see in practice — which factors were flagged, how the employee compares to peers in the same role, and what the confidence range on the score is.
The Article 13 obligation is on you as the provider to design the system so that this information is visible. The obligation on your customer (the deployer) is to ensure their HR managers use it before acting on the rating.
If your system generates a rating without surfacing the component inputs, your answer to this section will be weak. Fix the product; then the answer writes itself.
Article 10 — Data Governance and Protected Categories
Article 10 requires that training data be relevant, representative, and examined for possible biases. In the HR tech context, the follow-up question is almost always about protected characteristics.
The question arrives as: "How does your system ensure performance ratings do not disadvantage employees based on gender, age, ethnicity, or disability status?"
How to answer:
There are two distinct things your customer wants to know. First, whether you tested for disparate impact in your training data. Second, whether the model's live outputs show statistical parity across protected groups.
Honest answers acknowledge that no system achieves perfect parity. What Article 10 asks for is a documented methodology:
- Identifying which features correlate with protected characteristics
- Testing the training dataset for historical bias before model training
- Running fairness audits on the live system at defined intervals
If you have done this work, describe it concisely: what method you used (disparate impact analysis, equalized odds testing), what threshold you set for acceptable disparity, and what happened when you found a result that crossed that threshold.
If you have not done this work, your customer's procurement team will find out. The better path is to be direct about your current state and your roadmap.
The Section They Will Ask About Next
After Article 13 and Article 10, the next email usually asks about Article 14: human oversight. Specifically, whether their HR managers can override the system's rating, and what happens to the audit trail when they do.
The short answer: yes, they can. The EU AI Act requires it for high-risk systems. Design your override workflow so that the HR manager's decision and their documented reason are stored alongside the original AI output. That record is what protects your customer in an employment dispute.
Managing the Volume of These Questionnaires
A German manufacturing company's HR procurement team will not be the last to ask these questions. As the August 2026 EU AI Act enforcement deadline applies to high-risk systems, enterprise procurement teams across Europe are running the same playbook — the same questions, slightly different wording, different deadline each time.
The practical challenge is not knowing the answers. You know your system. The challenge is translating that knowledge into the exact format that 40 different procurement questionnaires will ask for.
