Why Insurance AI Gets Special Scrutiny
If your AI system evaluates individual creditworthiness or prices insurance products at the individual level, you're operating in EU AI Act Annex III territory — specifically points 5(b) (creditworthiness) or the broader "access to essential private services" category.
The scrutiny isn't arbitrary. Insurance pricing AI has a documented history of encoding discrimination via proxies. Regulators know this. Enterprise buyers at insurers have their own obligations — they can't deploy a vendor whose AI creates regulatory exposure.
Your answers need to demonstrate you've actually thought about this, not just checked a box.
The 4 Questions Your Insurer Buyer Will Ask
1. "Do you use proxy variables that correlate with protected characteristics?"
The honest answer: Almost certainly yes, if you use any behavioral or location data. Zip code correlates with race. Device type correlates with income. Browsing patterns correlate with age.
How to answer this well: Don't deny it. Explain what you've done about it:
- List the variables you've identified as protected-attribute proxies
- Describe how you test for disparate impact (holdout tests, counterfactual fairness analysis)
- Explain your variable-removal or re-weighting process when a variable produces discriminatory outcomes
- State whether you've had a third-party audit
Buyers at insurers are not naive about proxy discrimination. An honest answer with documented safeguards is far more credible than a denial.
2. "What fairness metrics do you optimize for and how do you balance them against predictive accuracy?"
What they're really asking: When you found a fairness-accuracy tradeoff, what did you decide?
How to answer: Name the fairness criteria you use: demographic parity, equalized odds, calibration within groups. Acknowledge the tradeoff — there is always one, this is a mathematical fact. Explain how you made the decision: who was in the room, what criteria you used, what you ultimately chose.
If you optimized for calibration within groups (same model accuracy across demographics), say so and explain why. If you accepted slightly lower overall accuracy to achieve demographic parity on pricing, explain that. This answer demonstrates you have a real process, not a checkbox.
3. "How do you handle edge cases where the model produces an outlier premium for an individual?"
What they're asking: Is there a floor/ceiling on what your AI can produce, and who reviews exceptions?
How to answer: Describe your override mechanism. EU AI Act Article 14 requires human oversight for high-risk systems. For pricing AI, this typically means: premiums above/below a threshold trigger a human review, the reviewer can override with documented reason, and the model learns from accepted overrides on a defined retraining cycle.
If your product doesn't have an override mechanism, this is the moment to build one before the deal closes.
4. "Provide documentation of your last bias audit, including methodology and findings."
What they're asking: Show your work.
How to answer: If you've done an audit, share the summary. If you haven't, be honest about where you are: "We conduct ongoing statistical testing via [method] and are preparing a formal third-party audit scheduled for [quarter]."
Don't share a report you don't have. Fabricating audit documentation is a deal-ender if discovered — and sophisticated buyers will probe.

The CTOs who close insurance AI deals fastest aren't the ones with perfect bias metrics. They're the ones who can explain their process clearly.
