1. "Does your system create individual employee profiles using AI inferences?"
What they're asking: Are you building per-employee scores that infer things the employee didn't explicitly provide — like engagement ratings, flight risk scores, or productivity percentiles?
How to answer: Be direct about what your system does. If you produce per-employee scores, say so. Then explain the safeguards: scores are surfaced only to HR business partners, accompanied by confidence intervals, and never trigger automated employment actions.
The key move: connect inferences to observable inputs. "Our engagement score is a weighted average of voluntary survey responses and collaboration graph density" is a better answer than "proprietary AI model." Buyers need to understand the chain from data to decision.
2. "What human review process exists before decisions affecting employees are made?"
What they're asking: Does a human have to approve or override before your AI output affects someone's employment?
How to answer: Describe your actual workflow. The EU AI Act (Article 14) requires "meaningful human oversight" — not just a rubber-stamp review button. If your product surfaces a "flight risk: 87%" score, explain who sees it, what action it can trigger, and what the reviewer considered before acting.
If your product is used purely for analytics (not automated decisions), state that clearly: "Our tool surfaces aggregate team patterns to managers. Individual employee action is always at the discretion of the HR lead, with no automated triggers in our system."
3. "How do you test for bias across protected demographic groups?"
What they're asking: Have you run your model against protected characteristics (gender, age, ethnicity, disability status) and verified it doesn't disadvantage any group?
How to answer: This is Article 10 territory (data governance) and Article 9 (risk management). You need a real answer here — "we don't collect demographics" is not sufficient. Explain what fairness tests you run (disparate impact analysis, equalized odds), what demographic proxies you guard against (zip code as income proxy, name as ethnicity proxy), and what your remediation process is when you detect drift.

If your product is deployed by an employer (you're the provider, the employer is the deployer), explain how your deployment documentation tells employers what transparency obligations they carry. This correctly shifts responsibility — you built the tool, they chose to deploy it.
5. "Describe your incident response process if the system generates incorrect assessments."
What they're asking: If your AI incorrectly flags someone as low-performing, what happens?
How to answer: Have a documented process: the deployer (employer) can flag an anomaly, you investigate and provide a corrected output with explanation, you maintain audit logs for 2 years (Article 12 requirement for high-risk systems), and serious incidents affecting employment decisions are reportable to your national market surveillance authority.
